Abbott asks court to reject Minnesota bid to force extradition of ICE officer

Texas Gov. Greg Abbott has asked a federal judge to block Minnesota's attempt to extradite ICE officer Christian Castro, arguing there are "serious concerns" about whether Castro even qualifies as a fugitive.

Castro was arrested May 29 in Cameron County on a warrant out of Minnesota. He's currently held in Cameron County Jail. Abbott's argument cuts to a legal gray area: Castro didn't flee Minnesota to avoid prosecution. He was apparently reassigned to Texas by Immigration and Customs Enforcement, which raises real questions about whether standard extradition rules apply to him at all.

Minnesota isn't letting this sit. The state is pushing for a court order to keep Castro locked up past Thursday, worried he'll disappear if released. Under Texas law, people awaiting extradition can only be held for 90 days. A hearing on whether Castro stays in custody is scheduled for Tuesday, and Abbott says Texas is still investigating whether the fugitive classification holds up.

For people here in Lubbock and across the state, this case puts federal immigration enforcement and state criminal law on a direct collision course. If a federal agency can reassign an employee across state lines and that move voids a criminal warrant, that's a significant precedent for how states pursue officers accused of crimes.

Castro's case may force courts to define exactly where ICE's authority ends and a state's criminal jurisdiction begins.
