The confusion traces back to a string of administrative rule changes that hit after years of Texans walking into shops and buying cannabis flower that looked, smelled and functioned like marijuana, legally, because it came from hemp instead. KUT reached out to sources trying to nail down the current law and found nobody willing to say for certain whether holding a jar of smokable hemp or a small amount of concentrate could still land someone with a felony charge.

The mess centers on THCA, a compound found abundantly in cannabis that does not get anyone high in its raw form. Heat changes that. A lighter flame or a vape rig converts THCA into Delta-9 THC, the plant's main psychoactive ingredient, blurring the line between legal hemp and illegal marijuana at the chemical level.

For smoke shops on the South Plains, that uncertainty is not academic. Employees and owners are stuck guessing what they can legally stock, sell or even hold in a back room. Customers walking in for a familiar product have no guarantee they are not carrying around a felony, and even the people whose job is to know this stuff could not tell KUT where the legal line actually sits.
